Before & After: Legal Basement Conversion in Scarborough

Written by AgileBuilds Ltd. - October 2026

Introduction

A finished basement is one thing. A legal basement suite is something else entirely, and for one Scarborough homeowner, the difference came down to permits, proper construction, and making the right call on a general contractor.

This is a real look at what a legal basement conversion in Scarborough actually involves: what the space looked like before, what changed during construction, and what the homeowner ended up with on the other side.

What the Basement Looked Like Before

The space was typical of many older Scarborough homes: an unfinished basement used primarily for storage. Low ceiling height, no proper egress window, exposed joists, and a bathroom rough-in that had never been completed.

From a livability standpoint, it wasn't close to legal. From a rental income standpoint, it was leaving money on the table every month.

The homeowner's goal was straightforward: convert the space into a self-contained legal rental suite that could generate consistent monthly income without putting them offside with the City of Toronto.

Why Legal Status Matters Before You Build

Before any work started, the first conversation was about permits, not finishes.

An illegal basement apartment may generate rental income in the short term, but it exposes the homeowner to real risk: insurance claims can be denied if an incident occurs in an unpermitted unit, and the City of Toronto has the authority to order an unpermitted unit vacated.

A legal basement suite requires a building permit and must meet the Ontario Building Code (OBC), including fire separation standards, ceiling height minimums, and egress window requirements. In Toronto, the unit must also meet zoning requirements under the city's Secondary Suite policies under Zoning Bylaw 569-2013.

What the Conversion Involved

Once permits were in place, the scope of work covered everything the space needed to meet legal requirements and function as a proper rental unit.

Structural and code compliance work:

• Installation of a new egress window to meet OBC requirements for emergency exit from a sleeping area

• Fire separation upgrade between the basement unit and the floor above, including fire-rated drywall and door assemblies meeting the OBC Section 9.10.9.14 minimum 45-minute fire-resistance rating

• Ceiling height review: OBC Part 9 requires 1.95m (6'5") minimum over at least 75% of the main living area; portions of this basement required minor adjustments to achieve compliant clearance

• Separate entrance installation to provide independent access for the tenant

Mechanical and systems work:

• Dedicated HVAC supply to the basement unit, legally required for habitability

• Electrical panel assessment and upgrade to support the new unit load; ESA (Electrical Safety Authority) inspection completed, as required for all new electrical installations in Ontario

• Plumbing completion: the existing rough-in was extended and a full bathroom was built out

Finishing:

• Egress-compliant window wells installed and waterproofed

• Full interior finish: flooring, kitchen, bathroom, lighting, to rental-ready standard

The After: A Legal, Rentable Unit

The finished suite is a self-contained one-bedroom unit with a separate entrance, full kitchen, full bathroom, and its own HVAC. It passed city inspection and received a Final Inspection Certificate from the City of Toronto upon permit sign-off.

The homeowner now has a legally operating second unit on the property: documented, insurable, and defensible if the City ever follows up.

What This Project Reinforces About Legal Conversions

A few things stand out from this project that apply to any legal basement conversion in Scarborough or across the GTA:

Permits protect you, not just the city. A permitted conversion means the work has been inspected. That matters when insurance claims arise, when you sell the property, or when a tenant dispute escalates.

The sequence matters. Permits first, then construction. Not the other way around. Starting work without permits and trying to legalize after the fact is significantly more complicated and expensive.

Every basement is different. Ceiling heights, structural layouts, existing plumbing, and lot zoning all affect scope. A proper site assessment before quoting is not optional, it's how you avoid surprises mid-build.
