If you own a home in Toronto and want to add a second unit, converting to a legal duplex in Toronto is one of the most practical ways to generate rental income while increasing your property's long-term value. But the process is more involved than most homeowners expect. Zoning rules, building permits, and Ontario Building Code requirements all apply, and getting any of it wrong can cost you time and money. This guide breaks down exactly what the process involves so you can go in with clear expectations.
A legal duplex is a residential property that contains two self-contained dwelling units, each with its own entrance, kitchen, bathroom, and living space, and that has been approved by the City of Toronto through the proper permit and inspection process.
The keyword is legal. An illegal or unpermitted second unit may appear functional, but it creates serious problems: it cannot be legally rented, an unpermitted second unit can create serious insurance coverage disputes, particularly at the time of a claim, depending on your policy wording and what was disclosed to your insurer, and it can trigger orders to remove the unit entirely. A legal duplex is inspected, compliant, and properly permitted, which protects both you and your tenants.
Under Ontario Regulation 299/19 — as amended by O. Reg. 462/24 in November 2024 — most residential properties in Toronto can now accommodate up to three residential units as of right, without requiring a zoning variance. This is a provincial regulation that overrides Toronto's Zoning By-law 569-2013, meaning the province-wide performance standards apply even where the city's own bylaw would previously have restricted additional units.
Key standards under the current regulation include:
• No minimum lot size on urban lands containing additional residential units
• At least 45% of the lot permitted to be covered by buildings and structures
• No floor space index limit on lots containing additional residential units
• Angular plane requirements overridden for additional residential units
• One parking space required per additional residential unit. Note that where a municipal zoning bylaw does not require parking for the primary unit, the provincial regulation's parking requirement does not apply. Confirm the requirement for your specific Toronto address and district before designing your project.
That said, zoning eligibility is not the only factor. Your property still needs to meet Ontario Building Code requirements for unit size, fire separation, egress, and mechanical systems. Before assuming your property qualifies in full, a site assessment from an experienced contractor is the right starting point. Eligibility depends on your specific lot and existing structure, not just the general regulatory category.
This is where many homeowners underestimate what is involved. A legal duplex conversion requires a building permit from the City of Toronto. For complete house-stream applications, which include detached, semi-detached, and row house conversions up to two units, the City targets a review period of 10 business days. Applications that qualify for Express Services can be reviewed in as little as 3 business days after intake.
The permit stage can move relatively quickly if your application is complete and correct. What drives the overall timeline is everything else: design and drawings, contractor scheduling, construction, and staged inspections. From the first design meeting to final occupancy approval, a realistic planning assumption for a full legal duplex conversion in Toronto is several months, and commonly 6 to 12 months depending on scope and complexity.
The general process looks like this:
1. Design and Drawings: Architectural drawings must be prepared by a qualified professional and submitted with your permit application. These drawings need to show the full layout of both units, exits, fire separations, and mechanical systems.
2. Building Permit Application Submitted to the City of Toronto's Building Division. The permit covers structural changes, plumbing, and HVAC work. Note that electrical work requires a separate notification and permit filed directly with the Electrical Safety Authority (ESA); having a building permit does not cover electrical. Both are required before electrical work is concealed.
3. Construction: Once the permit is issued, work can begin. All work must be done by licensed contractors. Structural and systems work cannot be concealed before the required inspections are completed.
4. Inspections: The city conducts inspections at multiple stages: framing, rough-in mechanical and electrical, and final occupancy. Each inspection must pass before proceeding to the next stage.
5. Final Inspection and Permit Close-Out: The permit must be formally closed out through a final inspection before the unit can legally be occupied. All inspection stages must be completed and passed before occupancy.
Trying to skip or shortcut any part of this process creates legal liability and can prevent you from selling or insuring the property correctly down the road.
Costs vary significantly depending on the scope of the conversion. A project involving an existing basement space with a separate entrance already roughed in is a fundamentally different undertaking than a full floor separation in a detached home that requires new mechanical systems, structural changes, and a new exterior entrance.
The factors that drive cost most significantly are:
• Whether a separate entrance already exists or needs to be created
• The extent of plumbing and electrical work required
• Whether HVAC systems need to be split or independently installed
• The degree of structural modification involved
• Permit fees, design fees, and HST — all of which are separate from construction costs
Every property is different, and accurate pricing is only possible after a site visit and a full review of the scope of work. Be cautious of any contractor who provides a firm number without seeing the property.

Hiring the wrong contractor. Not all renovation companies have experience with duplex conversions specifically. Ask directly whether the contractor has completed permitted duplex or multiplex projects in Toronto, and ask to see examples.
Not accounting for the full timeline. The permit review for a complete application can move in 2–3 weeks. The full project — design, construction, inspections, and occupancy approval — commonly takes 6 to 12 months. Plan accordingly.
